Court Ruling in summary proceedings: Vereniging voor Duurzame Energie vs. the Country Curaçao

On 29 January 2015 the Court pronounced its ruling in summary proceedings between the Vereniging voor Duurzame Energie (the Association) against the Country Curaçao.

Reason for the summary proceedings
The reason for initiating the summary proceedings, by the Association was the Ministerial Regulation on tariffs for retro-supply of sustainably generated electricity 2015, (Official Gazette 2014, no. 100) (the Regulation) entering into force.
This Regulation comprises that private and corporate end users shall owe a fixed fee of NAF. 16.– and NAF. 32.– respectively, per kWp installed PV-capacity per invoice period to Aqualectra Distribution.

On the other hand, based on this Regulation, Aqualectra Distribution must pay private and corporate end users a retro-supply tariff of NAF. 0.33 per kWh. Prior to the Regulation coming into effect, a netting principle was in force and the retro-supply tariff for private and corporate end users amounted to NAF. 0.42.
